1. Definitions

In these Terms of Service:

"SUPERFAN", "we", "us" or "the store" refers to ONE S&M LICENSES LLC, a Florida limited liability company doing business as SUPERFAN, based in Miami, Florida, United States.

"User", "customer" or "you" refers to any person who accesses our store or makes a purchase.

2. Acceptance of Terms

By using our website or making a purchase, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our website or services.

3. Licenses and Intellectual Property

All products sold on this site are officially licensed. ONE S&M LICENSES LLC is duly authorized to sell products under brands owned by third parties.

All designs, logos, characters, names and other protected content shown on this site remain the property of their respective owners and are used under valid licensing agreements.

Copying, reproducing, distributing or reselling as "official" any content or product design from this store without express written authorization is strictly prohibited.

4. Product Types and Production

Our store offers three types of products:

  • Made to order: produced after you order by our production partners.
  • In stock: physical items kept in stock and shipped from our Miami warehouse.
  • Digital products: downloadable items such as files or exclusive content.

Each product type has specific conditions for production, shipping and returns.

5. Shipping

Orders are shipped by our production partners and/or logistics centers. Estimated delivery times vary depending on the destination, the product type and where the item is produced.

Shipping, delivery and lost or damaged packages are governed by our Shipping Policy and our Return & Refund Policy, which form part of these Terms. Our team will always help you resolve any delivery issue.

6. Prices and Payments

Prices are shown in the currency selected on the site or at checkout, unless otherwise indicated.

Payments are processed securely through providers such as Shopify Payments, PayPal, Stripe or BlueSnap, depending on your region. We do not store full card details on our servers. Pay-later options, when offered, are governed by the provider's own terms.

We work to keep prices accurate. If a product was listed at an incorrect price, we will contact you before shipping and give you the option to confirm the order at the correct price or cancel it for a full refund.

All transactions are also subject to Shopify's Payment Terms and Data Processing Agreement.

7. Returns and Refunds

You may request a return or exchange within 15 days of delivery at super-fan.club/pages/returns. Eligible items must be unused, unwashed and in their original condition. You can choose store credit (item value plus a 10% bonus, with free return shipping), an exchange (free return shipping), or a refund to your original payment method (we provide a prepaid return label at no cost; everything you paid for the returned items is refunded except the original shipping cost, which is non-refundable).

If your order arrives damaged, defective or incorrect, we will replace it or refund it at no cost to you.

Personalized items, items marked as final sale, gift cards and digital products are not returnable. Full details are in our Return & Refund Policy, which forms part of these Terms.

8. Limitation of Liability

To the extent permitted by law, SUPERFAN is not liable for:

  • Damage, loss or injury arising from the misuse of our products.
  • Payment incidents caused by third-party providers.
  • Unauthorized reproduction or misuse of licensed content by third parties.

Our total liability is limited to the amount paid for the order in question. Nothing in these Terms limits rights you have under applicable consumer protection laws.

9. User Conduct

We may refuse or cancel any order and restrict access to our store if we detect:

  • Fraudulent behavior
  • Abuse of our commercial policies
  • Infringement of intellectual property rights
  • Any unauthorized or unlawful use of our site or services

10. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of Florida, United States. Any dispute will be resolved before the competent courts of Miami-Dade County, Florida.

If you are a consumer in the European Union, the United Kingdom or another country, this does not take away the protection of the mandatory consumer laws of your country of residence.

11. Modifications

ONE S&M LICENSES LLC may modify or update these Terms of Service at any time. The latest version will always be published on this page and takes effect when posted. Significant changes may be communicated by email or a notice on the website.

12. SUPERFAN™ Pass

Participation in the SUPERFAN™ Pass loyalty program (points, levels, member discounts and benefits) is governed by the SUPERFAN™ Pass Terms, which form part of these Terms of Service. Points have no cash value and cannot be sold, transferred or exchanged for money. ONE S&M LICENSES LLC may modify, suspend or end the program, its levels, benefits and conditions at any time; the version published on that page will always apply.

13. Age Requirement

By using this site or placing an order, you confirm that you are at least the age of majority in your state, province or country of residence, or that you are using the site with the involvement and consent of a parent or legal guardian. Purchases of products intended for children must be made by an adult. We do not knowingly collect personal information from children under 13.

14. Product Images and Colors

We make every effort to show our products accurately. Colors and print placement may vary slightly because of screen settings and the made-to-order printing process. These small variations are not considered defects.
